Charles A. Guyton

Charles A. Guyton serves clients primarily before state and federal administrative agencies and courts. He has more than 31 years of experience in the areas of public utility and telecommunications regulation, with more recent experience in project development, environmental matters and governmental procurement. In addition to providing administrative litigation services, he regularly advises clients regarding their interface with regulatory commissions in policy development and rulemaking. During his career, Mr. Guyton has represented consumers, investor-owned public utilities, rural electric cooperatives, municipal utility providers, co-generators and independent power producers, renewable energy providers, major equipment vendors, incumbent and competitive local exchange companies and interexchange telecommunications companies. His clients have included the fourth largest electric utility in the United States and the largest rural electric cooperative in Florida.

Mr. Guyton is a member of the American Bar Association’s Public Utility, Communications and Transportation Law and Environment, Energy and Resources Sections, The Florida Bar’s Administrative Law and Environmental Law and Land Use Sections and the Alabama State Bar. He is rated AV by Martindale-Hubbell and is listed in The Best Lawyers in America.

Representative Experience

    • Advising a nuclear vendor consortium on state regulatory matters, nuclear cost recovery and EPC contract negotiation.
    • Representing a Florida-based electric utility before the Florida Public Service Commission (FPSC) in revenue requirements proceedings involving more than US$1 billion.
    • Representing a Florida-based electric utility before the FPSC in securing cost recovery of more than US$1.5 billion in environmental compliance costs.
    • Securing for a Florida-based electric cooperative a determination of need for a US$1.5 billion coal-fired generating unit, the only such unit approved in the last 15 years.
    • Counseling electric utilities in the formulation and implementation of capacity solicitations approved by the FPSC and the Federal Energy Regulatory Commission.
    • Assisting developers and utilities in the negotiation, regulatory approval and cost recovery of power purchase agreements.
    • Successfully procuring and opposing determinations of need for more than 16 power plant projects.
    • Representing a co-generator in the United States Virgin Islands (USVI) in an interconnection proceeding, an RFP and a power purchase negotiation.
    • Defending a USVI project developer in CERCLA and Territorial Natural Resource Damages and remediation cases and water pollution and coastal zone management cases.
    • Representing a major Florida-based electric utility in successfully challenging the EPA’s Clean Air Interstate Rule.
    • Advising incumbent and competitive local exchange and interexchange telecommunications companies.
    • Representing an electric cooperative in a rate structure dispute among its members.
    • Representing entities in Florida procurement proceedings before the Department of Revenue, Department of Transportation and the Agency for Health Care Administration.
