Kendra S. Sherman

Kendra S. Sherman focuses her practice on all aspects of environmental counseling, compliance and litigation relating to air, water, solid and hazardous waste, wetlands, construction and demolition debris, and underground storage tank matters. She has appeared before a wide range of federal and state courts and administrative tribunals in defending corporate and municipal clients in state and federal environmental enforcement actions, third party permit challenges, citizen suit litigation and toxic tort matters. She also has considerable experience in Clean Air Act Title V, National Pollutant Discharge Elimination System (NPDES) and hazardous waste permit and closure plan appeals and prosecuting environmental claims on behalf of her clients. Ms. Sherman has represented several Ohio municipal clients in connection with annexation and extraterritorial utility service matters and has extensive knowledge of state law on those issues. In addition, she has experience counseling lenders, corporations and developers on environmental issues in complex commercial and real estate transactions.
Ms. Sherman is a member of the Columbus Bar Association Environmental Law Committee (on which she served as co-chair from 2004 through 2006) and is a member of the Ohio State Bar Association’s Environmental Law Committee. She was selected for inclusion in the 2010 edition of Ohio Super Lawyers-Rising Stars, a distinction that recognizes lawyers under the age of 40 or those in practice for 10 years or less. She is a frequent speaker on various environmental issues at seminars and engagements throughout Ohio.
Among her many pro bono activities, Ms. Sherman is the cofounder of Squire Sanders’ Dispute Resolution and Youth Program, a community service program aimed at teaching dispute resolution skills to inner city youth in Columbus in collaboration with The Ohio State University College of Law. She also has devoted a significant amount of time volunteering for The National Center for Adoption Law & Policy at Capital University Law School (NCALP) and received the 2003 Volunteer Lawyer of the Year award from the NCALP for her community service efforts.

Representing an ethanol production plant in defense of its air and water permits in appeals filed by a local citizen group, resulting in successful resolution of all issues in the appeals.

Representing several steel, manufacturing and industrial clients in numerous Title V permit appeals now pending before the Ohio Environmental Review Appeals Commission and Indiana Office of Environmental Adjudication and significant permit negotiations with environmental regulators in Ohio, Indiana and other states.

Representing municipal clients in federal and state court and in administrative hearings in matters involving extraterritorial utility service issues and water and wastewater management planning, utility service and annexation issues.

Representing corporations, municipalities and villages in administrative appeals pending before the Ohio Environmental Review Appeals Commission involving challenges to their NPDES permits, hazardous waste closure plans, Title V permits and air permits to install issued by Ohio EPA and extensive permit negotiations in the settlement and dismissal of the appeals.

Successfully prosecuting a Resource Conservation and Recovery Act (RCRA) citizen suit on behalf of a lender client, resulting in a permanent injunction requiring petroleum contamination cleanup of the lender’s property and award of our attorney fees.

Assisting in the representation of a municipality in connection with the defense of a Clean Water Act citizen suit filed regarding the city’s combined sewer overflows, resulting in a dismissal of the citizen suit on jurisdictional grounds.
- Counseling developers with respect to state permitting and local approvals required in connection with wastewater collection, treatment and land application systems and negotiating terms of agreements for those systems.
