Donald A. Wall’s practice includes a broad range of management labor and employment litigation and advice including claims involving sexual harassment and Title VII, Americans with Disabilities Act, Age Discrimination in Employment Act, Fair Labor Standards Act and Equal Pay Act, Worker Adjustment and Retraining Notification Act, ERISA, wrongful discharge, and express or implied contracts.

He has substantial experience dealing with state tort claims arising out of the employment relationship such as negligence in hiring, supervision or retention, defamation, invasion of privacy, intentional infliction of emotional distress, public policy tort, and fiduciary duty.

Other aspects of his work include confidentiality agreements, noncompetition provisions and breach of the covenant of good faith and fair dealing, employment manuals and policies, and employee training.

Mr. Wall’s practice also includes significant commercial litigation. He handles federal and state court litigation, administrative and regulatory proceedings, alternative dispute resolution and training programs.

Mr. Wall is co-author of several articles published in Arizona Journal including “Know the Implications of Sexual Harassment Investigations” and “The Effect of Faragher and Burlington Industries is Becoming Clear.” He is a frequent speaker at seminars and programs on employment and litigation issues. In 2001, he presented on ethical considerations for lawyers in ERISA law.

Mr. Wall is a member of the American Bar Association’s Sections of Tort and Insurance Practice, Labor and Employment Law and Litigation as well as the Labor and Trial Practice Sections of the State Bar of Arizona. He is also a member of the Defense Research Institute, Arizona Association of Defense Counsel and Maricopa County Bar Association.
