Her particular expertise covers commercial property disputes and commercial landlord and tenant disputes. Helen has more than 35 years’ experience advising on contentious property and landlord and tenant matters and of litigation, arbitration and mediation of property and landlord and tenant disputes.

  • Providing detailed strategic advice concerning the impact on possible rights to light of many adjacent freeholders and leaseholders of a city centre redevelopment site, which was crucial to the ability of the local authority and its partners to carry out important regeneration of large parts of a city centre.
  • Providing strategic advice and thereafter serving notices in relation to the occupation of part of the client’s site where a lease excluded from security of tenure expired several years ago; where there are separate commercial agreements and draft commercial agreements in place; and where the client requires possession.
  • Advising in circumstances where access to the client’s site is on land that does not form part of its registered title and where the owner of the land has offered the client a lease; and thereafter making a Land Registry application to register title by adverse possession.
  • Acting for a national retailer as tenant in very long-running lease renewal proceedings in circumstances where the client was trying to keep the proceedings alive while looking for a purchaser for the business to take a new lease direct from the landlord; and dealing with the termination of residential tenancies at the same property.
  • Acting for a residential developer in determining an agricultural tenancy of adjacent land to a development site in order to obtain reserved matters consent in accordance with the local fallow land management plan.
  • Acting for a national retailer in circumstances where it has taken an overriding lease following the payment of rent pursuant to an Authorised Guarantee Agreement; where it is looking to grant an underlease out of that overriding lease; where the original tenant was dissolved and reinstated; and where the original lease remains registered.
