Since 1992, our lawyers have served as counsel to the principal organizations promoting the development and deployment of Intelligent Transportation Services (ITS) in the United States. We have unique expertise with respect to the legal issues associated with ITS systems, services and technologies, including traffic information and management systems, digital mapping services, vehicle location technologies, collision avoidance radars, in-vehicle navigation systems, electronic toll systems, MAYDAY response systems and advanced vehicle control systems. Our firm provides counsel on telecommunications regulation, radio spectrum allocations, information privacy, standards development, tort liability, intellectual property, competition/antitrust, public procurement, government relations and other issues and projects associated with the deployment of ITS systems, services and technologies.
We represent diverse ITS interests including electronic toll providers, vehicle OEMs, government transportation agencies, project engineers, digital map makers, after-market equipment suppliers, information service providers, Tier 1 vehicle suppliers, software developers and trade associations. Squire Sanders lawyers have served as communications and regulatory counsel to ITS America since 1992. Our practice also brings us before agencies such as the US Department of Transportation, as well as those authorities in the United States, European Union and other nations whose regulations affect ITS.
Our ITS practice is international, and represents ITS clients in the United States, Europe and Asia. We represent ITS clients before US and European regulatory agencies for equipment authorization and radio spectrum allocations. In Europe, we have advised clients regarding the funding and deployment of electronic toll systems, and we have represented Japan-based vehicle equipment manufacturers and developers of electronic mapping systems and navigation tools.
ITS Practice Successes:
- Securing access to 75 MHz of radio spectrum for wireless communications (Dedicated Short-Range Communications or DSRC) to and from vehicles and roadside for electronic tolling, MAYDAY emergency response and the enabling of location-sensitive and mobile commerce.
- Advising on the allocation and deployment of the three-digit call-in number (511) for nationwide access to traveler information services.
- Obtaining government approval for new generations of vehicle radar equipment employing ultra-wideband (UWB) wireless technologies on behalf of a Tier 1 vehicle supplier.
- Advising on federal and state privacy law implications for deployment of cellphone probe technology for estimating real-time traffic conditions.
- Developing licensing and service rules for the DSRC radio spectrum.
- Advising a digital map maker on software licensing and liability issues.
- Advising on capitalization and financing for electronic tolling projects.
- Establishing a new ITS industry association.
